I've jointly inherited a property. Help me partition my share.

Joint ownership leaves your share undefined and vulnerable. We identify your exact portion, handle the filings, and work to get your share legally recognised and yours alone.

Whether everyone agrees or not, you have options

When property is inherited jointly, all co-owners share equal rights across the whole property, but no individual portion is physically defined. That ambiguity can become a real problem, particularly when you live overseas and someone else controls day-to-day access.

  • Uncontested partition

All co-owners agree to divide the property. We prepare the family settlement documentation, handle the filings, and register the outcome.

  • Contested partition

One or more co-owners refuse to agree, or are uncooperative. We file a partition suit on your behalf. Any single co-owner has the right to do this, and the court will divide the shares whether others consent or not.

Partitioned land also commands a better price at sale than unpartitioned land, so securing your individual share is not just about protection. It is also about value.

How we get your share separated and registered

  1. 1

    We establish each co-owner's share

We review the ownership records and confirm your exact legal entitlement before any filing begins.

  2. 2

    We file the case

Agricultural land cases are filed with the Tehsildar of the appropriate jurisdiction. Constructed property cases go to the civil court of applicable jurisdiction.

  3. 3

    We manage the on-ground work

We conduct site visits, coordinate with local commissioners, and handle measurements and mapping as required by the court or revenue authority.

  4. 4

    The property is divided

For agricultural land, shares are divided on the good-to-good, bad-to-bad principle, so each co-owner receives a portion of equal value.

  5. 5

    New titles are issued

Each co-owner's share receives its own registered title. Your share becomes yours to manage, sell or transfer independently.

If the property cannot be physically divided, for example a small constructed property with no clear unit separation, the court may order a sale and distribute the proceeds between co-owners.

Your partition questions, answered

Can I file for partition even if the other co-owners do not agree?
Yes. Any co-owner can file a partition suit regardless of whether the others consent. The court will proceed and divide the shares based on each person's legal entitlement.
Do I need to travel to India to start a partition case?
In most cases, no. A Power of Attorney holder can file and manage the case on your behalf. If your specific matter requires a physical presence at any stage, we will tell you clearly and in advance.
Can partition be done for any type of property?
Yes. We handle partitions for agricultural land, residential property and commercial property anywhere in India.
What happens once my share is partitioned?
Your share receives its own registered title. You can then sell, transfer or manage it completely independently of the other co-owners.
Does partitioned land have a different value?
Generally, yes. Partitioned land often fetches a better price at sale than unpartitioned joint property, because the buyer takes on a clearly defined, unencumbered asset.
